
Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Sydney Social Events website and application (the "Service") operated by Sydney Social Events Pty Ltd ("we", "us", or "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Eligibility
You must be at least 18 years of age to use the Service. By creating an account you represent and warrant that you are 18 or older, that you have the legal capacity to enter into a binding agreement, and that all information you provide is accurate and truthful. We reserve the right to terminate accounts found to belong to minors.
2. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate, current, and complete information during registration
- Keep your profile information up to date
- Notify us immediately of any unauthorised use of your account
- Not share your account credentials with any third party
- Not create more than one account per person
3. Subscriptions and Payments
Sydney Social Events offers paid subscription tiers (Silver, Gold, Gold Plus) billed monthly in Australian dollars. All payments are processed securely by Stripe. By subscribing you authorise us to charge your nominated payment method on a recurring monthly basis.
Launch Period: During our launch period (until 28 November 2026), full Gold-tier access is provided free of charge to all registered members. No credit card is required to access Gold features during this period.
Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing cycle; no partial refunds are issued for unused days.
Refunds: Refunds are issued at our discretion in accordance with Australian Consumer Law. If you believe you are entitled to a refund, please contact us at [email protected].
4. User Conduct
You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. You must not:
- Post or share content that is illegal, defamatory, harassing, threatening, obscene, or discriminatory
- Upload content depicting minors in any sexual context
- Impersonate any person or misrepresent your identity
- Use the Service to solicit money, promote commercial services, or engage in spam
- Attempt to access another member's account or private data
- Scrape, crawl, or systematically extract data from the Service
- Reverse-engineer, decompile, or attempt to derive the source code of the Service
- Upload malware, viruses, or any code designed to disrupt the Service
- Use the Service to facilitate real-world harm, stalking, or harassment of other members
We reserve the right to remove any content and suspend or terminate any account that violates these rules, without notice and at our sole discretion.
5. User-Generated Content โ Your Sole Responsibility
By uploading or posting any content to the Service โ including profile photos, audio tracks, videos, chat messages, social feed posts, or any other material โ you do so entirely at your own discretion and accept full, sole, and exclusive responsibility for that content. Sydney Social Events Pty Ltd holds no responsibility, fault, or liability for any content you or any other member uploads or shares.
By uploading content you grant Sydney Social Events Pty Ltd a non-exclusive, royalty-free, worldwide licence to host, store, display, and distribute that content solely for the purpose of operating the Service. You retain ownership of your content.
You represent and warrant that you own or have the necessary rights to all content you upload, that it does not infringe any third-party rights, and that you accept all consequences of uploading it.Sydney Social Events Pty Ltd will not be held responsible or at fault for any content you choose to upload.
6. Music and Copyright
The music voting and streaming features on the Service use publicly available YouTube content via the YouTube API. We do not host or redistribute copyrighted audio files. DJ tracks sold through the DJ Marketplace are uploaded by independent artists who represent and warrant that they own the rights to that content. We are not liable for copyright infringement by third-party sellers.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
8. Intellectual Property
All content, trademarks, logos, and software forming part of the Service (excluding user-generated content) are the property of Sydney Social Events Pty Ltd or our licensors and are protected by Australian and international intellectual property laws. You may not reproduce, modify, or distribute any part of the Service without our prior written consent.
9. No Responsibility โ Platform Provider Only
IMPORTANT โ PLEASE READ CAREFULLY
Sydney Social Events Pty Ltd holds absolutely no responsibility, fault, or liability of any kind for any content uploaded, shared, or posted by members, or for any actions taken by members on or off this platform. By using the Service, you acknowledge and agree that you act entirely on your own accord and at your own discretion.
Content uploaded at your own discretion: Any photo, video, audio recording, message, post, or any other content you upload or share on the Service is done entirely at your own discretion and your own risk. You are solely and exclusively responsible for all content you submit. Sydney Social Events Pty Ltd does not review, endorse, verify, or take any responsibility whatsoever for any content posted by any member. By uploading content, you accept full and sole responsibility for that content and any consequences arising from it. Sydney Social Events Pty Ltd holds no fault and shall not be held liable under any circumstances for member-uploaded content.
You act on your own accord: All decisions you make while using the Service โ including decisions to meet other members in person, attend events, share personal information, or engage in any communication โ are made entirely on your own accord.Sydney Social Events Pty Ltd is not responsible for, and expressly disclaims all liability for, any outcome, loss, injury, harm, damage, or consequence of any kind that arises from your use of the Service or your interactions with other members, whether online or offline.
No fault held by Sydney Social Events Pty Ltd: Sydney Social Events Pty Ltd does not investigate, monitor, verify, or guarantee the identity, age, intentions, honesty, or behaviour of any member. We hold no fault and accept no liability for any member's conduct, misrepresentation, or actions. Any reliance you place on information provided by other members is entirely at your own risk.
Third-party content: The Service may display or link to third-party content (including YouTube videos and external websites). Sydney Social Events Pty Ltd has no control over and accepts no responsibility for any such third-party content or the practices of third-party platforms.
10. No Copying of Member Content
Strict No-Copy Policy
All content created and shared by members on Sydney Social Events is private and protected. Copying, saving, screenshotting, screen-recording, downloading, or redistributing any member content is strictly prohibited, except as expressly permitted below.
Prohibited actions include:
- Screenshotting or screen-recording another member's profile photo, avatar, or personal images
- Copying, saving, or redistributing private messages, Dreams & Hopes content, or chat room media
- Downloading or re-uploading audio tracks, videos, or photos posted by other members
- Using any automated tool, browser extension, or script to extract member content
- Sharing any member's personal content outside the Service without that member's explicit written consent
Exception โ Live Window shared content: Content that a member has deliberately shared through the Live Window feature (e.g., a broadcast or shared clip that the member has made available for others to view) may be saved or shared by the recipient only if the sharing member has explicitly enabled the share/save option for that content. The absence of a share/save option indicates the content is view-only and must not be copied.
Violation of this policy may result in immediate account suspension or termination, and may expose the offending member to civil and criminal liability under Australian copyright, privacy, and surveillance laws, including the Copyright Act 1968 (Cth) and the Privacy Act 1988 (Cth).
11. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. To the extent permitted by Australian Consumer Law, we disclaim all such warranties.
12. Limitation of Liability โ No Fault Held
To the maximum extent permitted by law, Sydney Social Events Pty Ltd and its directors, employees, contractors, and agents hold no fault and shall not be liable for any loss, damage, injury, harm, or consequence of any kind โ whether direct, indirect, incidental, special, consequential, or punitive โ arising out of or in connection with your use of the Service, your interactions with other members, or any content you or any other member uploads or shares.
You acknowledge that you use the Service and upload content entirely on your own accord, at your own discretion, and at your own risk. Sydney Social Events Pty Ltd holds no fault for any outcome arising from your independent decisions and actions on or off the platform.
Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim, or AUD $100, whichever is lesser.
Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law that cannot be excluded or limited by agreement.
13. Indemnification
You agree to indemnify and hold harmless Sydney Social Events Pty Ltd and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
14. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for breach of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) shall survive.
15. Governing Law and Disputes
These Terms are governed by the laws of New South Wales, Australia. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of New South Wales, Australia.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the effective date and notify you via email or an in-app notice at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
